These Terms of Service ("Terms") govern your use of the Ferrabelle app and this website (ferrabelle.com), operated by Cobblewright LLC, a Washington limited liability company ("Ferrabelle," "we," "us"). By creating an account or using Ferrabelle, you agree to these Terms. If you do not agree, do not use Ferrabelle.
1. Eligibility
You must be at least 18 years old to use Ferrabelle, and you confirm this at signup.
2. The service
Ferrabelle is a general-wellness app for tracking your menstrual cycle, body, training, symptoms, and related insights. We may add, change, or remove features over time.
3. Not medical advice, important
Ferrabelle is for general wellness and educational purposes only. Ferrabelle is not a medical device, is not a form of contraception or birth control, must not be used to prevent or achieve pregnancy as a contraceptive method, and does not diagnose, treat, cure, or prevent any disease or medical condition. Predictions and insights are estimates and may be inaccurate. Always consult a qualified healthcare professional for medical decisions. You use Ferrabelle at your own discretion.
4. Your account
You are responsible for your login credentials and for activity under your account. Provide accurate information and keep your password secure.
5. Your data and content
You own the data you put into Ferrabelle. You grant us a limited license to process it solely to provide the service to you, as described in our Privacy Policy and Consumer Health Data Privacy Policy. You can export or delete it at any time, including from our account deletion page.
6. Subscriptions and payments (Fe+)
Ferrabelle is free to use, including cycle prediction, your daily Fe Score, and unlimited logging. Fe+ is an optional paid subscription that unlocks premium features such as the training forecast, Fe Score history, advanced insights, the doctor report, partner sharing, and data export.
- Plans: Fe+ is offered at $9.99 per month or $59.99 per year, with a 7-day free trial on new subscriptions. A one-time Founder Lifetime option may also be offered.
- Billing: subscriptions are sold and billed through the Apple App Store or Google Play using your store account. Prices may vary by region and may change on renewal with notice.
- Free trial and renewal: if you start a free trial and do not cancel before it ends, it converts to a paid subscription. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.
- Managing and canceling: manage or cancel your subscription anytime in your Apple or Google account subscription settings. Deleting the app does not cancel a subscription.
- Refunds: refunds are handled by the app store under its policies.
7. Acceptable use
Do not misuse Ferrabelle: no unlawful use, no attempting to access others' data, no reverse-engineering or disrupting the service, and no automated scraping.
8. Disclaimers
Ferrabelle is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law, including any warranty of accuracy, fitness for a particular purpose, or that predictions will be correct.
9. Limitation of liability
To the maximum extent permitted by law:
- Ferrabelle, Cobblewright LLC, and our owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to Ferrabelle, these Terms, or your use of or inability to use the app or website, regardless of the legal theory (contract, tort, negligence, strict liability, warranty, or otherwise), and even if we were advised of the possibility of such damages and even if a stated remedy fails of its essential purpose.
- Our total aggregate liability for all claims arising out of or relating to Ferrabelle is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or 100 US dollars.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or fraud, liability for personal injury caused by our negligence to the extent it cannot be waived, or any non-waivable rights you have under the Washington My Health My Data Act or other consumer-protection law. Because some jurisdictions do not allow certain limitations or exclusions, some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
10. Termination
You may stop using Ferrabelle and delete your account at any time. We may suspend or terminate accounts that violate these Terms.
11. Changes to these Terms
We may update these Terms. We will post the new effective date and, for material changes, notify you in-app.
12. Governing law and disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Nothing in these Terms limits any non-waivable rights you have under the Washington My Health My Data Act or other applicable law.
